Terms of Service
These are the rules for using Lumi. By signing up, you agree to them. They're a real legal contract between you and us — but we've tried to write them so you can actually read them.
"We," "us," and "our" mean Bishwas Khanal, an independent developer in Nepal who builds and runs Lumi. "You" means you, the person using it.
1. Who can use Lumi
You need to be at least 13 years old. If you're between 13 and the legal age of adulthood where you live, you can only use Lumi if a parent or guardian agrees to these Terms on your behalf. By signing up, you're saying that's true.
2. Your account
You sign in through Google. Keeping your Google account safe is on you — we can't undo damage from a stolen Google login. If you think someone has broken into your Lumi account, tell us right away via the contact form with topic "Security." We'll act fast.
One person, one account, unless we agree otherwise in writing. You can't sell, trade, or hand your account to someone else.
3. What Lumi is
Lumi is a personal AI companion. It accepts messages, voice, files, photos, and (with your permission) certain notifications. It uses AI models to write replies, manage reminders, search your photos, speak, and remember things about you over time.
Lumi is still being built. Features will change. Some will be added, some will be retired. When we make a big change, we'll give reasonable notice.
4. Lumi's replies aren't always right
Lumi runs on language models. They're useful, but they're also wrong sometimes — confidently. Don't rely on Lumi for medical, legal, financial, or safety decisions. If it matters, check with a qualified human.
You can use anything Lumi generates for you however you want, for your own purposes. You're responsible for what you do with those replies.
5. Your stuff stays your stuff
Everything you put into Lumi — messages, files, photos, profile info, notifications you've shared — is yours. We call it "Your Content."
You give us permission to host, store, transmit, and process Your Content only as needed to run Lumi for you. When you delete something, that permission ends — subject to the brief deletion windows in the Privacy Policy.
We do not train any AI model on Your Content. We do not sell or rent it. Not to anyone.
By submitting Your Content, you're confirming you have the right to share it (it's yours, or you have permission), and that sharing it doesn't break the law or hurt anyone else's rights.
6. Things you can't use Lumi for
Don't use Lumi to:
- break the law, or help anyone break the law;
- create or share content that sexually exploits children, or any non-consensual sexual content;
- incite real-world violence;
- harass, threaten, defame, or dox another real person;
- create malware, scam content, or anything used for fraud;
- impersonate someone in a way meant to deceive;
- scrape Lumi at scale, automate it from outside the official app, or attack our security;
- upload viruses or content you don't have the right to share;
- make decisions with serious legal or comparable effects on other people without a human in the loop.
If you do any of this, we may suspend or close your account. We'll usually tell you first and give you a chance to fix things, but we won't always be able to (especially for serious abuse).
7. Connected services (Pro)
If you connect Gmail, Calendar, Drive, or Google Tasks (a Pro feature), you're also bound by Google's terms when using those through Lumi. Lumi only touches the permissions you approved. You can disconnect any service any time in Settings — we revoke the access at Google and delete our copy immediately.
8. Free and Pro
Lumi has two tiers:
- Free — costs nothing. Includes a daily chat allowance, a photo storage limit, a 90-day rolling memory window, and basic voice features. No connected services.
- Pro — paid monthly or yearly. Removes the daily and storage limits, keeps memory forever, and unlocks voice cloning and connected services. Current price is on the pricing page.
Prices may change. If we change Pro's price, current subscribers keep the old price for at least one billing cycle, and we'll notify you before the new price applies. Cancel any time from Settings — you drop to Free immediately and get to keep what's left of your paid period. Refunds for partial months are at our discretion; we don't promise them.
9. Lumi the brand
The name "Lumi," the mascot, this website, the mobile app, and the underlying software are owned by Bishwas Khanal. We give you a limited, personal, non-transferable, revocable permission to use Lumi as described in these Terms. You can't copy, modify, sell, or rent it, and you can't reverse-engineer security stuff (except where your local law specifically allows it).
The server and Android-app source code are open source — see github.com/ZarbieK-9/persona-ai. Open-source code is governed by its own licence; these Terms are about the hosted service we run for you.
10. The "no warranties" part
Lumi is provided "as is" and "as available." We don't promise it will work perfectly, never break, fit your specific purpose, or hold all your most important data forever. You use it knowing that.
11. The "limit on damages" part
To the maximum extent allowed by law, we're not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business — even if we knew they were possible.
Where we have to be liable, our total liability to you for any claim relating to Lumi over any 12-month period won't exceed the larger of (a) what you actually paid us in that period, or (b) USD $50.
Some places don't allow these kinds of limits. Where the law overrides them, this section applies only as far as the law allows.
12. The "you cover us" part
You agree to cover us against claims, demands, losses, or damages (including reasonable legal fees) brought by someone else because of (a) Your Content, (b) you using Lumi against these Terms, or (c) you breaking the law or someone else's rights.
13. Ending the relationship
You can delete your account any time from Settings — we'll honour the deletion windows in the Privacy Policy. We can suspend or close your account if you break these Terms or if your usage puts the service or other users at risk. After it ends, the parts of these Terms that naturally outlast the relationship (like the limits-on-damages and open-source code) keep applying.
14. Changes to these Terms
We update these Terms when Lumi changes. For meaningful changes, we'll tell you in the app and by email at least 14 days before the change takes effect. If you keep using Lumi after that, you're accepting the new Terms. If you don't agree, please stop using the service before they take effect.
15. Where things get decided
These Terms are governed by the laws of Nepal. Courts in Kathmandu have exclusive jurisdiction over disputes about Lumi — except we can ask any competent court for an emergency order if we need to. Nothing in this section takes away rights you have as a consumer where you live, when those rights can't be waived.
16. Small-print bits
- If a court strikes down part of these Terms, the rest still applies.
- These Terms plus the Privacy Policy are the entire agreement between you and us about Lumi.
- If we don't enforce a rule once, we haven't given it up — we can enforce it later.
- You can't transfer these Terms to someone else. We can transfer them as part of a merger, acquisition, or sale of the business.
